Forms Integrated into the EKR System Modified
With the version switch of 17.10.2019 in the EKR system, new forms integrated into the system will be presented

With the version switch of 17.10.2019 in the EKR system, new forms integrated into the system will be presented.

Any procurement procedure created by a contracting entity in the EKR system after 17.10.2019 will include these kinds of forms (it is not the day of the initiation of the proceedings that matters, but the date the procedure has been created in the system, so it may happen e.g. that a procedure created on the 08.10.2019 will be initiated by a contracting entity only in 2020).

Accordingly, several current tenders include the ‘old’ forms, but more and more public procurement procedures will include the new forms, so let us briefly sum up which they are:

 

  • TENDERER’S STATEMENT concerning the competence requirements specified in the invitation that opens the procedure
  • DECLARATION on business trade secrets
  • Declaration on the chartering of the collaterals within the time limit
  • Declaration on the tender guarantee
  • Bidder’s declaration concerning professional indemnity insurance
  • Bidder’s declaration concerning liability insurance
  • On the specialists presented in respect of the standards of competence specified in the calling for competition
  • Professional experience of the specialists presented in respect of the standards of competence specified in the calling for competition
  • Declaration on minimum facility requirements specified
  • Declaration on responsible translation

 

All the above declarations have a character limit, i.e. bidders shall not write texts of arbitrary length into the forms (character limit changes from form to form, being between 400 and 4000 characters including spaces)

Any declaration form shall become editable for an economic operator if they confirm they wish to submit the declaration form. Should the economic operator fail to tick the box on the top of the forms labelled “I wish to submit this form”, the declaration shall be considered a non-submitted declaration.

Should the economic operator wish to submit their bid and the included online forms without having declared the acceptance and submission of each specific form, the system will alert having failed to indicate the acceptance of the content of the declaration, the intention to submit the declaration, therefore, these declarations shall not be submitted as a part of the official act, resulting in the invalidity of the offer / appeal. The submission of the official act may be continued or interrupted by replying the question “Will you continue the submission? Yes/No”.
